X-IT and Kidde (A) Case Solution & Answer

It involves a start-up, X-IT Products LLC, whose founders have developed an innovative, lightweight and easy to use – but tough – escape ladder. After X-IT has filed a patent application for the scale of the United States, X-IT was approached by Kidde PLC, one of the largest providers of fire protection in the world. The negotiations to license the invention of X-IT or buy X-IT followed. The parties signed a confidentiality agreement, which gave access to the patent attorney Kidde X-IT applications to close confidential information purposes Kidde if the claims were weak or strong. After the X-IT representatives Kidde founder saw a ladder showing a major exhibition that was almost identical to the scale of X-IT, X-IT CEO had to decide what to do next. While pursuing Kidde for breach of the confidentiality agreement was an option, X-IT had barely enough cash to respond to commands, not to mention the costs of lawyer compensation.
